Civil lawsuits against abortion pill traffickers now possible in Mississippi

TUPELO, Miss. Mississippi Governor Tate Reeves has signed House Bill 1613 into law. This legislation classifies the creation, distribution or sale of abortion pills as a form of drug trafficking. Violators can be imprisoned for not less than one (1) year and up to ten (10) years. The state’s Attorney General can also bring an action against violators for civil penalties, injunctive relief and victim restitution. The ban does not include treatments, such as chemotherapy medications and diagnostic drugs, not intended to cause an abortion, but instead prescribed for legitimate medical purposes.

“After we overturned Roe v. Wade with the Dobbs case, Mississippi’s last abortion clinic closed,” said Dr. Jameson Taylor. “Since that time, dangerous abortion-causing drugs have flooded into our state. These pills can be obtained online or through social media without a prescription and without any medical guidance or follow-up. This is truly a public health crisis that is harming women, killing babies and driving up healthcare costs for families, whose taxes are subsidizing emergency care for these women.” Dr. Taylor is director of the Center for Government Renewal, part ofAFA Action, the governmental affairs affiliate of the American Family Association.

“If you violate this law, be ready to go to jail for a long, long time,” added Trey Dellinger, Senior Legal Fellow for AFA Action. “But your freedom isn’t all you’ll lose — you’ll also lose your ill-gotten gains. Violators can be forced to pay civil penalties to the state and restitution to the women who are hurt from getting these illegal and dangerous drugs.”

“Abortion is illegal in Mississippi because it is a barbaric, harmful practice,” said Dr. Taylor. “Abortion pill traffickers, whether they’re dealing these drugs in Mississippi, or selling them out of California, New York, India or the Netherlands, are going to be held accountable under state law, both criminal law and civil law. We are grateful to Rep. Celeste Hurst for her incredible leadership in getting this bill passed. We also want to thank Rep. Dan Eubanks, House Judiciary B Committee Chair Rep. Kevin Horan, and Vice Chair Rep. Jansen Owen for shepherding this bill through the House. Longtime pro-life champion Senator Joey Fillingane likewise expertly guided this bill to passage in the Senate. Speaker Jason White’s leadership and support were also vital. Thank you, too, to Lt. Governor Delbert Hosemann for supporting this legislation and to Governor Tate Reeves for signing HB 1613 into law.”
