SCOTUS ruling reignites abortion pill battle

TUPELO, Miss. In what some are calling “the most sweeping abortion restriction” since the overturn of Roe v. Wade, a three-judge appeals court panel temporarily suspended women from obtaining the abortion pill, mifepristone, delivered by mail. Approved by the FDA in 2000, the Biden administration removed the requirement in 2023 for women to see a health care provider before receiving the pill. But last year, Louisiana Attorney General Elizabeth Murrill sued the FDA, stating its rules permitting mifepristone to be acquired via mail orders worked against the state’s ban on abortions at any stage of pregnancy.

A manufacturer of the pill and defendant in the lawsuit requested the appeals court to put its order on hold to allow the company time to seek relief from the Supreme Court. And yesterday, SCOTUS ruled in favor of mifepristone, restoring broad access to the pill.

“This case is now where it belongs — before the Supreme Court,” said Walker Wildmon, CEO of AFA Action, the governmental affairs affiliate of the American Family Association. “For years, the Biden administration’s policy has allowed abortion pills to bypass state laws and expand abortion through the mail. Now the Court will decide whether that authority actually exists and whether federal agencies can override duly enacted state protections for life. This is a defining moment for state sovereignty, and the protection of women and their unborn children, and the outcome will have far-reaching consequences across the country.”
